Elon Musk's Legal Dispute with Colorado Over AI Legislation on Hold Amid State Revisions

The legal confrontation between Elon Musk’s artificial intelligence firm, xAI, and the state of Colorado has been temporarily paused.

A joint filing submitted by xAI and Colorado Attorney General Phil Weiser requested a federal court to cancel the June 16 scheduling conference and suspend all deadlines related to xAI’s lawsuit against Senate Bill 24-205. This bill aims to prevent ‘algorithmic discrimination’ in high-risk AI systems. The request also halts enforcement of SB24-205 or any revised legislation passed during this legislative session while Colorado lawmakers deliberate potential changes, and the court considers xAI’s anticipated motion for a preliminary injunction.

Earlier this month, xAI filed a lawsuit against Colorado to prevent the implementation of its law. The company claims that SB24-205 would mandate changes in AI system operations and limit model response generation. “SB24-205 is decidedly not an anti-discrimination law,” stated xAI’s attorneys in their initial complaint, asserting it embeds the state’s preferred perspectives into AI systems.

The lawsuit contends that the bill infringes on the First Amendment by compelling xAI’s chatbot, Grok, to respond in ways aligned with Colorado’s stance on diversity and fairness. Furthermore, it argues that SB24-205 is ambiguous for fair enforcement, attempts to regulate activities beyond state borders, and discriminates between AI systems based on their responses.

The joint filing notes that a policy group formed by Governor Jared Polis released a draft bill on March 17 intended to repeal and replace SB24-205. The attorney general announced his office will refrain from enforcing the law or issuing related rules until legislative sessions and rulemaking conclude.

Under this agreement, the attorney general declared he would not initiate enforcement actions against xAI for alleged violations until 14 days following a court decision on xAI’s anticipated injunction request.

xAI consented to file its motion for a preliminary injunction within 28 days after the final adoption of rules implementing the law or any new legislation.

The dispute intensified when, last week, the U.S. Department of Justice intervened in support of xAI. This case is part of an ongoing debate over AI regulation authority in the United States, with states like Colorado, New York, and California pursuing their own regulations while a federal approach has been advocated during the Trump administration.
